You sued your doctor.
For medical malpractice.
For causing you harm and injury.

A medical expert has confirmed your doctor was careless.
Our medical expert has confirmed that his wrongdoing caused you harm.
Your treating doctor confirms that your injury is permanent.

We start a lawsuit on your behalf claiming that your doctor violated the basic standards of medical care causing your injuries. Your doctor denies all of your allegations.

But instead of answering the allegations in your lawsuit papers, the defense does something drastic. They immediately ask the court to dismiss your case claiming that your case has NO MERIT!

Can they do that?

The answer is yes, they can.
It's called making a motion for summary judgment in lieu of (instead of) filing an answer.
An 'answer' is the document the defense uses to respond to your allegations.

The defense wants to get a few bites at the apple and will do everything they can to try and get your case dismissed. This is just the first attempt. More will follow.

Once they submit their papers claiming that there's no merit to your case, we must then respond to those arguments and explain to the Judge how your case DOES have merit.
